3. Account Registration

To use certain features of our Services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and current.
• Maintain the security of your account credentials and accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorised use of your account or any other breach of security.

4. Billing and Payments

All paid Services are billed in advance on a monthly or annual basis, depending on the subscription plan selected. Payment is processed securely through Stripe. By subscribing to a paid plan, you agree to the following:

• All fees are quoted in British Pounds Sterling (GBP) unless otherwise stated.
• Subscription fees are non-refundable except as expressly set forth in these Terms or as required by applicable law.
• We reserve the right to change our pricing with 30 days' prior notice. Price changes will take effect at the start of the next billing cycle.
• Failure to pay may result in suspension or termination of your Services.

5. Free Tier

Cd hosting offers a free tier with limited resources for personal projects and development environments. The free tier is subject to fair usage policies and may be modified or discontinued at any time. Free tier accounts that remain inactive for more than 90 consecutive days may be subject to suspension.

6. Acceptable Use Policy

You agree not to use our Services to:

• Violate any applicable laws, regulations, or third-party rights.
• Distribute malware, viruses, or any other malicious software.
• Engage in cryptocurrency mining without prior written approval.
• Send unsolicited bulk email (spam) or engage in phishing activities.
• Host content that is illegal, defamatory, or infringes on intellectual property rights.
• Attempt to gain unauthorised access to other systems or networks.
• Interfere with or disrupt the integrity or performance of our Services.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

7. Service Level Agreement (SLA)

We strive to maintain high availability for all our Services. Specific uptime guarantees vary by plan: Basic (99.9%), Pro (99.95%), Enterprise (99.99%), and Ultimate (99.99% with custom SLA options). In the event that we fail to meet the applicable uptime guarantee, you may be eligible for service credits as described in our SLA documentation. Scheduled maintenance windows are excluded from uptime calculations.

8. Data and Backups

While we provide backup services as part of our hosting plans, you are ultimately responsible for maintaining your own backups. Cd hosting shall not be liable for any loss of data. Backup frequency varies by plan: weekly (Basic), daily (Pro), hourly (Enterprise), and continuous (Ultimate). We recommend maintaining independent backups of all critical data.

9. Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard or by contacting our support team. Upon cancellation, your service will remain active until the end of the current billing period. We offer a 30-day money-back guarantee for new customers on their first subscription. Refund requests after the 30-day period will be evaluated on a case-by-case basis.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Cd hosting and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our Services.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
